LGBT Community and their rights

LGBT stands for lesbian, gay, bisexual and transgender. This community in India have been looked with despicable eyes in the higher class society and they have mostly been ostracised from the mainstream community. As human rights concern have grown significantly over the years, thanks to the media.,these community has got a platform to voice their concern.Homosexuality is considered like a taboo in India and most religions condemn such acts and has termed it unnatural. In India,Delhi High Court held Sec 377 of India Indian Penal Code as unconstitutional and it paved the way for decriminalizing homosexuality in 2009.But recently SC adjudged that Sec 377 of IPC is constitutionally valid and it again made homosexuality illegal. Now,IPC SEC 377 says that any carnal intercourse against the order of nature is punishable offence.Science has proved that sexual orientation towards same sex is not unnatural and many people from birth have such orientations. So,by upholding religious views on homosexuality I think SC has overlooked facts. Now,people say that SC only talked about constitutionality of sec377 but as it infringes fundamental rights such as Right to Life,Right against Exploitative Discrimination and Right to Equality, the decision has raised eyebrows.I think SC could have done better and should have set an example by proving that courts doesn't run only by words of law.Reasonableness and suitability of law according to modern times should be kept in mind while giving verdict where Indian judiciary is still conservative. What is forbidden in religion need not to be forbidden in law.It is none of state's concern to look on what people are doing in their bed with each other's consent. We have definitely gone back to 1860 and the ball is now in Legislatures court to amend law so as to provide LGBT community their fully deserved rights.I wish it happens at the earliest.
